Terms of service
§ 1. GENERAL PROVISIONS AND SELLER INFORMATION
- These Terms and Conditions (hereinafter: "Terms") govern the use of the online store operated at woofroot.com and woofroot.pl (hereinafter: "Online Store" or "Store").
- The Online Store is operated by:

(hereinafter: "Seller" or "Woof Root")
- The Online Store operates on the Shopify platform. The Seller is the sole party to the sales agreement — Shopify is not a party to any sales agreement and bears no responsibility for the fulfillment of orders.
- These Terms are made available free of charge on the Store's website at all times, in a manner that allows their retrieval, reproduction, and storage.
- Use of the Online Store requires:
- a device with Internet access,
- a current version of a web browser (Chrome, Firefox, Safari, Edge),
- an active email account,
- cookies enabled.
§ 2. DEFINITIONS
The following terms used in these Terms shall have the meanings set forth below:
- Customer — a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality that makes or intends to make a purchase in the Store.
- Consumer — a Customer who is a natural person making a purchase in the Store for purposes not directly related to their business or professional activity (within the meaning of Article 22¹ of the Polish Civil Code). The provisions concerning Consumers also apply to natural persons concluding an agreement directly related to their business activity, where the content of the agreement indicates that it is not of a professional nature for that person (Article 385⁵ of the Polish Civil Code).
- Product — a movable item available in the Store's offering, being the subject of a sales agreement between the Customer and the Seller, in particular dog treats and snacks.
- Order — a declaration of intent by the Customer submitted via the order form, aimed at concluding a sales agreement for a Product with the Seller.
- Sales Agreement — a distance sales agreement for a Product concluded between the Customer and the Seller through the Online Store.
- Account — the Customer's individual panel in the Store, containing data provided by the Customer and information about placed Orders.
- Order Form — an interactive form available in the Store enabling the placement of an Order.
§ 3. RULES OF USE
- The Customer is obliged to use the Store in a manner consistent with the law and good customs, with respect for the personal rights and intellectual property rights of the Seller and third parties.
- The Customer is obliged to provide truthful, current, and complete data in the forms available in the Store.
- It is prohibited for the Customer to submit unlawful content, in particular content that infringes the rights of third parties, content that is offensive, misleading, or contains malicious software.
- The Customer bears sole responsibility for the security of their Account login credentials and for all activity on the Account.
- The Seller reserves the right to suspend or delete a Customer's Account in the event of a breach of these Terms.
§ 4. PRODUCTS AND PRICES
- The Seller makes every effort to ensure that the descriptions and photographs of Products published in the Store are accurate and correspond to the actual characteristics of the Products. Due to individual device settings, Product colors may differ slightly from how they appear on screen.
- Product prices displayed in the Store are expressed in Polish zloty (PLN) or euros (EUR) and include VAT.
- The price shown next to a Product does not include delivery costs, which are communicated to the Customer during the ordering process before confirmation.
- The Seller reserves the right to change Product prices, introduce and withdraw Products from the offering, and to conduct and cancel promotional campaigns. Changes do not affect Orders that have already been placed and confirmed.
- In the event of a price reduction, the Seller shall display, alongside the reduced price, the lowest price of the Product that was in effect during the 30-day period prior to the reduction (in accordance with the requirements of the EU Omnibus Directive).
§ 5. PLACING ORDERS
- Orders in the Online Store can be placed 24 hours a day, 7 days a week.
- Placing an Order involves the following steps:
a) selecting a Product and adding it to the cart,
b) completing the order form with delivery and invoice details (if applicable),
c) selecting a delivery method,
d) selecting a payment method,
e) reviewing and accepting these Terms,
f) clicking the "Order with obligation to pay" button (or equivalent).
- Clicking the "Order with obligation to pay" button constitutes the Customer's offer to purchase the selected Products.
- After placing an Order, the Customer receives an automatic confirmation of its receipt at the provided email address. This confirmation does not yet constitute acceptance of the Order for fulfillment.
- The Sales Agreement is concluded when the Seller confirms acceptance of the Order for fulfillment, of which the Customer is informed by a separate email.
- The Seller reserves the right to refuse an Order in justified cases, in particular when the data provided by the Customer is incorrect or incomplete.
§ 6. PAYMENT METHODS
- The Seller provides the following payment methods:
a) Shopify Payments (Visa, Mastercard, Apple Pay, Google Pay, Shop Pay),
b) BLIK,
c) Przelewy24 (instant bank transfers),
d) PayPal,
e) other payment methods available at the time of placing the Order.
- Payment should be made promptly after placing the Order. If payment is not received within 3 business days of placing the Order, the Seller reserves the right to cancel the Order.
- The Seller does not store Customer payment card data. Payments are processed by third-party payment operators (Stripe/Shopify Payments, Przelewy24, PayPal), which ensure transaction security.
§ 7. DELIVERY
- Products are delivered within the territory of the Republic of Poland and to selected European Union countries, as indicated in the Store.
- Delivery costs are communicated to the Customer during the ordering process and depend on the selected delivery method, shipment weight, and delivery address.
- Estimated delivery time within Poland is 2–3 business days from the date of shipment. Delivery times to other EU countries may vary depending on the destination country.
- Orders are dispatched within 1–2 business days from the date payment is received.
- The stated delivery times are estimates only. The Seller is not liable for delays caused by the carrier, customs processing, or circumstances beyond its control (force majeure).
- The Customer is obliged to inspect the shipment upon receipt. If mechanical damage incurred during transport is identified, the Customer should prepare a damage report in the presence of the courier and promptly notify the Seller.
§ 8. RIGHT OF WITHDRAWAL (CONSUMERS)
- A Consumer who has concluded a distance Sales Agreement has the right to withdraw from it without giving any reason within 14 days from the day on which the Consumer took possession of the Product, or on which a third party other than the carrier and indicated by the Consumer took possession of the Product.
- To exercise the right of withdrawal, the Consumer should inform the Seller of their decision by means of an unambiguous statement sent:
- by email to: hello@woofroot.com, or
- by post to: ul. Milczańska 18c/15, 61-131 Poznań, Poland.
- To meet the withdrawal deadline, it is sufficient for the Consumer to send the statement before the deadline expires.
- In the event of withdrawal, the Consumer is obliged to return the Product to the Seller promptly, no later than 14 days from the date on which the Consumer informed the Seller of the withdrawal.
- The Product should be returned in an unimpaired condition, in its original packaging, unless the change was necessary within the scope of ordinary management (e.g., opening the packaging to inspect the Product).
- The Consumer bears the direct costs of returning the Product, unless the Seller has agreed to bear them or has failed to inform the Consumer of the obligation to bear such costs.
- The Seller shall refund all payments received from the Consumer, including delivery costs (except for additional costs resulting from the Consumer's choice of a delivery method other than the least expensive standard method), promptly and no later than 14 days from the date of receipt of the withdrawal statement. The refund shall be made using the same payment method used by the Consumer, unless the Consumer agrees to a different refund method.
- The Seller may withhold the refund until the Product is received back or until the Consumer provides proof of its return, whichever occurs first.
- The right of withdrawal does not apply to Consumers with respect to agreements where the subject of performance is a Product which is liable to deteriorate or expire rapidly, in accordance with Article 38(4) of the Polish Consumer Rights Act of 30 May 2014. This applies in particular to dog treats delivered in packaging which, after opening, cannot be returned for health protection or hygiene reasons (Article 38(5) of the Polish Consumer Rights Act).
- The Seller informs that for Products that are unopened and in their original, sealed packaging, the right of withdrawal applies as described above.
§ 9. COMPLAINTS AND CONFORMITY OF GOODS WITH THE CONTRACT
- The Seller is obliged to deliver a Product that is in conformity with the contract.
- A Product is in conformity with the contract if, in particular, its description, type, quantity, quality, completeness, functionality, and fitness for a particular purpose communicated by the Consumer to the Seller no later than at the time of conclusion of the contract and accepted by the Seller, remain in conformity with the contract (in accordance with Chapter 5a of the Polish Consumer Rights Act of 30 May 2014).
- The Seller is liable for any lack of conformity of the Product with the contract existing at the time of delivery and revealed within 2 years from that time.
- In the event of a lack of conformity of the Product with the contract, the Consumer may request:
a) repair or replacement of the Product,
b) a price reduction or withdrawal from the contract — if repair or replacement is impossible or would require disproportionate costs, or the Seller has failed to carry out the repair or replacement within a reasonable time, or the repair or replacement would cause significant inconvenience to the Consumer.
- Complaints may be submitted:

- A complaint should include:
a) the Customer's full name,
b) email address or correspondence address,
c) a description of the identified lack of conformity of the Product with the contract,
d) the Customer's request (repair, replacement, price reduction, withdrawal from the contract),
e) proof of purchase (e.g., order number, payment confirmation, receipt).
- The Seller shall consider the complaint and inform the Customer of the resolution within 14 days of its receipt. Failure to respond within this period shall be deemed acceptance of the complaint.
- A Customer exercising rights under the conformity of goods with the contract provisions is obliged to deliver the defective Product to the Seller's address at the Seller's expense.
§ 10. OUT-OF-COURT DISPUTE RESOLUTION
- The Consumer has the option of using out-of-court complaint and claim resolution methods, including:
a) submitting a request to a permanent consumer arbitration court operating at the Trade Inspection Authority for dispute resolution,
b) submitting a request to the provincial inspector of the Trade Inspection Authority to initiate mediation proceedings,
c) seeking assistance from a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection.
- The Consumer may use the Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr/. The ODR platform serves as a point of access for consumers and traders seeking out-of-court resolution of disputes concerning contractual obligations arising from online sales agreements.
§ 11. LIABILITY TOWARDS BUSINESS CUSTOMERS
- This section applies exclusively to Customers who are not Consumers or natural persons referred to in § 2(2) of these Terms.
- The Seller's liability towards a Customer who is not a Consumer is limited to the value of the Order placed.
- The Seller shall not be liable for lost profits towards a Customer who is not a Consumer.
- The Seller reserves the right to withdraw from an agreement concluded with a Customer who is not a Consumer within 14 days of its conclusion, without giving a reason.
§ 12. INTELLECTUAL PROPERTY
- All content available in the Online Store, including texts, graphics, logos, photographs, icons, Product descriptions, video and audio materials, as well as the layout and appearance of the Store, are the property of the Seller or its licensors and are protected by copyright law, industrial property law, and other applicable legislation.
- Use of the content available in the Store is permitted solely for personal use. Any commercial use of the content without the prior written consent of the Seller is prohibited.
- The name "Woof Root," the logo, Product names, and slogans are trade designations of the Seller and may not be used without written consent.
§ 13. PERSONAL DATA PROTECTION
- The controller of Customers' personal data is the Seller.
- Customers' personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the Polish Personal Data Protection Act of 10 May 2018.
- Detailed information regarding the processing of personal data, including the purposes and legal bases of processing, data retention periods, the rights of data subjects, and information about cookies, is contained in the Privacy Policy available at: [LINK TO PRIVACY POLICY].
- As the Store operates on the Shopify platform, certain personal data may be processed by Shopify Inc. in accordance with Shopify's privacy policy available at: https://www.shopify.com/legal/privacy.
- Providing personal data is voluntary but necessary for the fulfillment of Orders and the provision of services by electronic means.
§ 14. REVIEWS AND USER CONTENT
- The Customer may post opinions and reviews concerning Products in the Store. Reviews should be honest, truthful, and relate to Products that the Customer has actually used.
- By posting a review, the Customer grants the Seller a free, non-exclusive license to use the review for marketing and informational purposes, including on the Store's website and social media.
- The Seller informs that it does not verify whether reviews originate from Customers who have actually purchased or used a given Product, unless expressly stated otherwise (in accordance with the requirements of the EU Omnibus Directive).
- It is prohibited to post reviews that are unlawful, offensive, untrue, misleading, or that infringe the rights of third parties. The Seller reserves the right to remove such reviews.
§ 15. SERVICES PROVIDED BY ELECTRONIC MEANS
- The Seller provides the following free-of-charge services by electronic means:
a) maintaining a Customer Account in the Store,
b) providing access to the order form,
c) providing a newsletter (upon the Customer's separate consent).
- The agreement for the provision of the Account service is concluded for an indefinite period. The Customer may terminate the Account at any time by sending a message to hello@woofroot.com or by independently deleting the Account.
- The agreement for the provision of the newsletter service is concluded for an indefinite period. The Customer may unsubscribe from the newsletter at any time by clicking the unsubscribe link included in each message or by contacting the Seller.
- Complaints regarding services provided by electronic means may be submitted to hello@woofroot.com. The Seller shall consider the complaint within 14 days.
§ 16. THIRD-PARTY LINKS
- The Store may contain links to websites operated by third parties. The Seller is not responsible for the content, privacy policies, or practices of third-party websites.
- The Customer accesses third-party websites at their own risk and should review the terms and privacy policies of such websites before engaging in any transactions.
§ 17. FINAL PROVISIONS
- These Terms are effective as of [INSERT DATE].
- The Seller reserves the right to amend these Terms for important reasons, such as changes in legislation, changes in payment or delivery methods, or changes in the scope of services provided. The Customer shall be notified of any changes at least 14 days in advance.
- Changes to these Terms do not affect Orders placed before the date the changes take effect — such Orders are governed by the Terms in effect on the date the Order was placed.
- In matters not regulated by these Terms, the provisions of Polish law shall apply, in particular:
- the Civil Code of 23 April 1964,
- the Consumer Rights Act of 30 May 2014,
- the Act on Provision of Services by Electronic Means of 18 July 2002,
- Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
- Any disputes arising from Sales Agreements between the Seller and a Consumer shall be resolved by the court having jurisdiction in accordance with the provisions of the Polish Code of Civil Procedure. Any disputes arising from Sales Agreements between the Seller and a Customer who is not a Consumer shall be resolved by the court having jurisdiction over the Seller's registered office.
- The invalidity of any individual provision of these Terms shall not affect the validity of the remaining provisions.
- These Terms do not exclude or limit any rights of the Consumer arising from mandatory provisions of law. In the event of a conflict between the provisions of these Terms and such legal provisions, the legal provisions shall prevail.
